Effective date: October 20, 2026 

These Terms of Service ("Terms") govern your use of hurtle.ca (the "Site") and your purchases from 807447 Ontario Limited, operating as Hurtle Canada ("Hurtle Canada", "we", "us"). Please read them before ordering. Nothing in these Terms limits your rights under the consumer protection laws of your province or territory, including Quebec's Consumer Protection Act. Where a provision is not permitted by those laws, it does not apply to you. 

1. Eligibility 

To buy on the site, you must have reached the age of majority in your province or territory, and you must provide accurate information. The Site serves customers with delivery addresses in Canada. 

2. Products and descriptions 

We try to describe and display products accurately. Colours may vary slightly by screen. Product availability can change. If a product you ordered becomes unavailable, we will tell you and refund you in full. 

3. Prices, taxes and payment 

• All prices are in Canadian dollars (CAD) and include every mandatory fee. Only applicable sales taxes (GST/HST, QST or PST) are added at checkout, and they are shown before you pay. 
• Payment is charged when you place your order. We accept the payment methods shown at checkout. 
• If a price is listed in error, we will contact you before shipping, and you may cancel for a full refund. Where the law requires us to honour the advertised price (including in Quebec), we will. 

4. Orders and contract formation 

Before you submit an order, the checkout shows the product description, itemized price, shipping cost, taxes, total, currency, delivery estimate, and our return and cancellation policies. When you place an order you will receive an order confirmation by email. That email is your copy of the agreement, and we send it within 15 days of the order (in practice, right away). We may refuse or cancel an order for suspected fraud, stock issues or obvious errors. If we do, we will refund any payment in full. 

5. Cancellation

• You may cancel an order within 24 hours of purchase if it has not shipped, by emailing contact@hurtle.ca. 
• If we do not deliver within 30 days after the delivery date we gave you (or within 30 days of your order if no date was given), you may cancel the order and receive a full refund, as provincial consumer laws allow. 
• If we did not give you the information your province requires before you ordered, you may have additional statutory cancellation rights (for example within 7 days of receiving your copy of the agreement). If we do not refund you within the legal time limit after a valid cancellation, you may ask your credit card issuer to reverse the charge. 

6. Shipping, returns and warranty 

Our Shipping Policy, Return & Refund Policy and Warranty Policy form part of these Terms. 7. Safe use of products 

Read and follow the manual, the age and weight limits, and the safety warnings for every product. Always wear a helmet and protective gear when riding a scooter, tricycle or bike. Rules for electric scooters on roads, bike lanes and sidewalks differ by province and municipality, and some places do not allow them on public roads. You are responsible for checking and following the laws where you ride. Adults must supervise children using our products. 

8. Reviews and content you submit 

Reviews must be honest, based on your own experience, and must not be offensive or unlawful. By submitting content, you allow us to display it on the Site and in our marketing, with your first name or chosen display name. We do not edit reviews to change their meaning, and we do not post fake reviews. 

9. Acceptable use and intellectual property 

Do not misuse the Site, interfere with its security, scrape it, or use it for unlawful purposes. All Site content, including the Hurtle name, logos, images and text, belongs to us or our licensors and may not be used without permission. 

10. Warranties and liability 

Our products come with the Hurtle Canada Warranty and with the legal warranties provided by your province's laws, which cannot be excluded. In Quebec, these include the legal warranty of quality under the Consumer Protection Act. Except for those warranties and to the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the Site. Nothing in these Terms excludes or limits our liability for our own fault, for personal injury, or for any liability that cannot be limited under applicable law. 

11. Governing law and disputes 

These Terms are governed by the laws of the province or territory where you live and the federal laws of Canada that apply there. You may bring any claim before the courts of your province or territory, including small claims court. We do not require arbitration, and nothing in these Terms

prevents you from joining a class action. If you have a problem, contact us first at contact@hurtle.ca. Most issues can be resolved quickly. 

12. Changes to these Terms 

We may update these Terms. Changes apply only to orders placed after the new version is posted. The Terms in effect when you placed your order apply to that order. 

13. Language 

These Terms are available in French and English. The parties have expressly agreed that these Terms and all related documents be drawn up in French and in English. Les parties ont expressément convenu que les présentes conditions et tous les documents s'y rattachant soient rédigés en français et en anglais.
